Board Deadlocked on Subdivision

On Nov. 13, the Middletown Planning Board heard a Motion for Reconsideration on the request for Master Plan approval for a proposed subdivision off Mitchell’s Lane. The matter had been continued for a variety of reasons over the last several months until finally being heard at the board’s Nov. 8 meeting.

After testimony by representatives of the applicant, Mark Brennan, and residents opposed to the application, and with the recusal of one board member, the board was deadlocked after voting on the proposal.

The Motion for Reconsideration was then filed with a request that the matter be put back on the board’s agenda. “A vote to approve the Motion for Reconsideration is not a vote in favor of the proposal, nor does it obligate you to vote in the affirmative should the motion be approved and you put it back on the agenda,” Town Solicitor Peter Reagan told the board. “If you vote to deny the motion, the applicant has the right to appeal that decision to the zoning board.”

Board Chairman Paul Croce made a motion to reconsider, which was seconded and unanimously approved by the six voting members. The proposed Master Plan will be heard at the planning board’s Dec. 13 meeting.
